 GETTING STARTED

STEP 1 – RULES AND INSTRUCTIONS

Please review Rule 14-717- Readmission of Utah attorneys after resignation without discipline, administrative suspension of three or more years, resignation with discipline, or disbarment.

STEP 2 – APPLICANT TYPE

Determine which application you will need to file.

  • Formerly-Admitted Applicants resigning without discipline or after administrative suspension of three or more years- There are two ways to be readmitted for attorneys in this group. 
    • If applicant can establish engaging in the full-time practice of law (at least 80 hours a month) for 36 of the previous 60 months, the formerly-admitted applicant  may apply for readmission using the application titled Formerly Admitted Attorney- No Exam Required.
    • If applicant is unable to show active practice of law, the applicant is required to take the bar examination again and should use the application titled Formerly Admitted Attorney- Exam Required
  • Disbarred Attorney Examination Application- This application is only for applicants who are seeking readmission to the bar after they have been disbarred or have resigned their license  with discipline pending, in any jurisdiction. The  correct application for attorneys in this group is the Disbarred Attorney Attorney Application.

Review the Rules Governing Admission to ensure you understand all of the requirements for your applicant type.

STEP 3 - REGISTER AND COMPLETE APPLICATION

Create an online account and complete the correct application form.

STEP 4 – COMPLETE THE CHARACTER AND FITNESS QUESTIONNAIRE

Please provide all information requested in the Character and Fitness Questionnaire. All applicants for admission to the Utah State Bar will be required to request a character and fitness report from the National Conference of Bar Examiners (NCBE). After submitting the Application and Character and Fitness Questionnaire, applicants will receive a link from the NCBE with instructions to request the report. STEP 5 – PHOTO

 

Obtain and upload a passport-style photograph that can be used for identification purposes.

This photograph will used on your bar card. It will also be used to verify your identity at the examination. The photograph must be in color, it must be recent (within the last year) and it must be different from your government ID (i.e. do not scan your driver’s license or passport). If your appearance changes before the day of the test (e.g. hair color or facial hair), you will need to upload a new photo.

STEP 6 – NOTARIZATION

Upload the signed and notarized the forms Applicant Verification and Authorization and Release.

STEP 7 – FEES

Pay the application fees.

$1000 for formerly-admitted applicants (Resigned without discipline or administrative suspension for 3 or more years.)

$5000 for Disbarred Attorney Exam Applications.

STEP 8 – SUBMIT YOUR APPLICATION

After conducting a final review of your application to ensure it is complete and accurate and that you have complied with all instructions, click the Final Submit button.

The date you click the Final Submit button is the date your application is considered FILED. If the Admissions Office finds you have clicked the Final Submit button and your application is not complete, you may be subject to additional fees or your application may be rejected.

STEP 9 – MPRE SCORE REPORT

Request a copy of your MPRE score report be sent to the Bar.

MPRE scores are deemed valid only if transferred to the Utah State Bar directly from the MPRE testing authority. Please visit the NCBE’s website for information on requesting the transfer of your score to Utah.

The report does not have to be received before the filing deadline or prior to sitting for the examination. However, all Applicants are required to receive at least an 86 on the MPRE with a before their application is approved for admission. The MPRE is administered by the National Conference of Bar Examiners. Any questions about registration, content or study helps should be directed to the NCBE. The NCBE’s website is www.ncbex.org. The MPRE is administered three times each year, usually in March, August, and November.

STEP 9 - TEST ACCOMMODATIONS AND COURTESY PROVISIONS (If necessary on exam applications)

If you need test accommodations that affect the format or administration of the exam (e.g. extra time, a private room, extra breaks, etc.) and you have a documented disability that qualifies you for test accommodations under the Americans with Disabilities Act (ADA), you may file a request for Test Accommodations using the Utah State Bar forms found on our website.

All requests must be accompanied by current, supporting medical documentation. Incomplete requests will be denied.

If there are any items that you need to bring with you into the exam room, such as food, medicine, special equipment, etc. which do not affect the format or administration of the test itself, use the Courtesy Provisions for Health-Related Conditions form to make your request. With the Courtesy Provisions form, you will need to provide a note from your doctor verifying your medical condition and explaining why you must have access to the item(s) at all times or why you need the special seating.

STEP 10 – EMAIL

Check your email and your online account regularly for announcements and correspondence. Respond promptly if the correspondence requests anything from you.
